1.1 Welcome to Kaci Help (“Kaci,” “we,” “our,” or “us”). These Terms of Use (“Terms”) form a binding agreement between you (“you,” “your,” or “User”) and the organizations behind Kaci Help. The platform is powered by FactCheck Initiative and developed by IDC Platforms Limited.

Kaci provides access to features such as TravelSafe, Consultation, Ambulance, Beeps, Climate, InfoBank, Suggestions, Feedback, SOS, and Press Releases, among others.

Important Notice: Kaci does not provide medical, security, or emergency services. Ambulance services, security responses, and similar services accessible through the App are provided by independent third parties. In case of a medical or safety emergency, you must contact your local emergency services immediately. Always seek professional medical advice for health concerns. Do not disregard or delay medical consultation based on information obtained through Kaci.
1.2 Privacy
Our Privacy Policy is a separate document that explains the personal information we collect, how it is used and shared, and the choices available to you. Please review it carefully as it forms part of your agreement with us.
1.3 Operator
FactCheck Initiative (CAC/IT/NO 130560) is a registered non-governmental development organization in Nigeria. FCI focuses on research, verifying and double-checking information, and exploring sustainable ways to secure funds or donations that support solutions offered through Kaci Help.
IDC Platforms Limited provides the technical backbone of Kaci Help. This includes software development, staff and training management, data protection, and other critical technical operations required to ensure the App runs securely and effectively.

1.5 Eligibility
You must be at least 13 years old to use Kaci. If you are between 13 and 18 years old, you may use Kaci only with the consent of your parent or legal guardian. By using Kaci, you confirm that you meet these requirements.
1.6 Acceptance of Terms
By accessing or using Kaci, you agree to be bound by these Terms. If you do not agree, you must not use the Kaci mobile application or related services.
1.7 Language
These Terms are provided in English. However, the Kaci mobile application is available in 11 languages: English, Arabic, French, Chinese, Fula, Igbo, Hausa, Portuguese, Yoruba, Pidgin, and Spanish.

4.1 Kaci offers users access to publicly available information to promote awareness, verify internet content, and take informed actions. Through its mobile application and WhatsApp interface, Kaci enables users to stay informed, track climate-related data, and connect with emergency support. Additionally, Kaci can alert pre-saved dependents (emergency contacts) instantly during emergencies or when users activate the TravelSafe feature.

4.2 Kaci is available free of charge, with select premium or subscription-based services available via the mobile app and WhatsApp. Users may opt in for additional features as they are rolled out.

4.3 Kaci is designed to provide information and supportive tools only. It does not claim to be a licensed emergency response provider, security expert, or medical authority. While the services offered are built to support emergency situations, the decision to act on the information provided, including but not limited to requesting an ambulance or initiating consultations, is solely at the discretion of the user.

4.4 Kaci does not generate new or private information. All data, news, and alerts shared through the platform are curated from already publicly accessible sources or are user-submitted.

4.5 Medical Responsibility Disclaimer: If users encounter medical emergencies after interacting with Kaci, whether through health-related alerts, consultations, or symptom-checkers, the choice to request an ambulance or contact healthcare providers lies entirely with the user. Kaci does not replace professional healthcare advice or diagnosis.

4.6 Kaci is not a prediction-based app. It does not offer betting tips, weather forecasts, or AI-generated future projections.

4.7 The Kaci Chatbot operates exclusively via WhatsApp. Kaci is not currently functional on Instagram, Facebook, Telegram, or other platforms. An active internet connection is required for it to function effectively on WhatsApp.

4.8 Kaci Services Overview
Kaci offers a suite of services designed for personal and community well-being, including but not limited to the following:
• Emergency
Allows users to send emergency alerts to their saved contacts. Kaci automatically notifies registered dependents with location and incident details.
• Consultation
Users can reach out for emotional or general consultation via the Kaci platform. This service is designed to offer a listening ear, direct users to appropriate mental health resources, or escalate to emergency response when required. It is not a replacement for professional therapy but may serve as a first step toward it.
• TravelSafe
Enables users to share live travel details with loved ones. Kaci tracks journey progress and automatically alerts emergency contacts if the user signals distress or fails to check in as scheduled. This tool is particularly useful in urban commutes, intercity travel, and during transit through high-risk zones.
• Ambulance
Through the app, users can request ambulance services. Kaci facilitates the request process but is not responsible for delays, availability, or service quality of the responding ambulance provider.
• iReport
Enables users to report verified or witnessed community issues (e.g., crime, road blockage, harassment) to appropriate authorities or community groups. This promotes shared vigilance and communal problem-solving.
• Suggestion
Users may submit ideas, feedback, and suggestions that improve the platform or bring attention to overlooked issues. This service ensures the app evolves in line with real-world needs.
• Climate
Allows users to track their carbon usage, understand their impact, and access tips on reducing their environmental footprint. While not a live CO₂ sensor, Kaci uses estimations based on travel activity, energy use, and other behaviors logged in-app.
• InfoBank
A curated resource hub that provides users with articles, helplines, policies, public service updates, health info, and more. Urban users benefit from region-specific guides, while all users can access national and global insights.

• Beeps (Public & Anonymous)
Kaci’s Beeps feature allows users to share thoughts, observations, suggestions, experiences, warnings, or general posts with the Kaci community. These posts can be made publicly with your name or identity or anonymously, depending on your preference. Whether named or unnamed, Beeps are meant to create safer, more informed, and emotionally aware communities.
Guidelines for Beep Usage:
-All Beeps must adhere to Kaci’s community guidelines, which strictly prohibit the spread of false information, -hate speech, incitement, harassment, or any form of abuse.
-Beeps must not defame, threaten, or infringe upon the privacy or rights of others.
-Users are encouraged to use the Anonymous Beep feature responsibly and truthfully. Anonymity does not remove accountability.
-For privacy and safety reasons, Anonymous Beeps cannot be searched directly through the Beep Search feature. They will appear only within general community feeds or alerts. This measure protects the identity and security of users who choose to remain anonymous, while still allowing their messages to contribute to community awareness.

Moderation and Enforcement:
-All Beeps public or anonymous are subject to moderation, both by automated systems and human reviewers.
-Repeated violations, trolling, false reports, or harmful content may lead to:
Shadow Banning: Your content may no longer be visible to other users without notification to you.
Temporary Suspension: You may be blocked from posting or interacting on the platform for a set period.
Permanent Ban: In cases of repeated, malicious, or highly inappropriate behavior, your account can be permanently removed from the app.
Reporting and Accountability:
-Users can report inappropriate or harmful Beeps. Kaci will investigate all flagged content.
-Even when using anonymous Beep mode, Kaci retains the right to track violations back to the originating account for enforcement purposes.
-The Beeps feature is designed to amplify genuine voices while protecting vulnerable users. Abuse of this tool undermines the purpose of Kaci and will not be tolerated.
• Alerts and Messages
Important messages, public safety alerts, and service reminders are sent via in-app notifications, WhatsApp messages, or SMS.
• Email, SMS, and WhatsApp Notifications to Dependents
During Emergencies and TravelSafe activations, Kaci automatically sends critical updates, including user location and status, to the user’s listed dependents via SMS, email, or WhatsApp.
• Kaci Verify Hub (Strict Access)
The Kaci Verify Hub provides a secure environment for verified users and authorized agencies to search, view, and confirm user information. It can be accessed through the Kaci Help app under the “Profile” section by selecting “Verify Hub,” or via the following links: https://www.kaci.help/verify, or https://verify.kacihelp.com.
Users log in using their registered phone number and password, while agencies use their email and password. Only registered users and verified agencies can view, download, or confirm Kaci Security Number (KSN) details and search records.
Upon login, users can view and download their Kaci Help Card (KHC), which includes their Profile Image, KSN, Full Name, Phone Number, Email, Agency, Guardian Details, Country, Location, Address, Medication Details, Date of Birth, Blood Group, and QR Code.
Users or Agencies may search for other users by KSN only when a valid reason is selected from the approved Kaci Help Search Reasons Dropdown, which includes:

• Accident Victim: Unconscious
• Accident Victim: Conscious
• Robbery or Assault Victim
• Kidnapping/Abduction Case
• Missing Person Verification
• HMO Coverage Verification
• Medical Emergency: Chronic Condition
• Medical Emergency: Trauma/Injury
• TravelSafe Incident/Roadside Emergency
• Routine Patient Registration/Treatment Verification
• Security/Law Enforcement Verification
• Disaster/Mass Casualty Response
• Personal / Family Information

All searches must be made only when important, relevant, and necessary, and must strictly align with the selected reason. Unauthorized, curiosity-driven, or repeated searches without just cause constitute a violation of user privacy and may result in suspension or permanent restriction of access.

When a search is made:
–Users can view limited information of other users, such as Profile Image, KSN, Full Name (with verification badges), Agency, Blood Group, and Guardian Details.
–Verified agency accounts with strict privileges can search for users, by KSN, Phone Number, Name, or Reason, and may access full user details including Profile Image, Full Name (with verification badges), Country, Location, Address, Agency, Guardian Details, Medication Details, Date of Birth, and Blood Group.
-All searches are logged for security purposes. Kaci Administrator reserves the right to monitor search activity, contact users or agencies for verification, and suspend or permanently restrict access in cases of misuse or suspicious activity.
-Kaci Help fully complies with the Nigeria Data Protection Act (NDPA) and the regulations of the Nigeria Data Protection Commission (NDPC), as well as international standards under the General Data Protection Regulation (GDPR). All personal data processed through the Verify Hub is encrypted, stored securely, and accessed only under lawful and ethical conditions.
-Kaci Help does not share or sell user data to any third party. All access logs, including search reasons and timestamps, are recorded and monitored to ensure accountability. Persistent violations or abuse may lead to immediate suspension or permanent banning of access to the Verify Hub.

It is important for individuals to help, and one of the ways to achieve this is by knowing how much carbon one contributes. One can calculate their own carbon emission; this is one of the benefits we offer. Through our app and partner websites we provide a free-of-charge platform to calculate your personal CO2. You can customize your search to know your daily, weekly, monthly and yearly emission. With a simple questionnaire, you can get highly specific results on your emission. The specific calculation formula is our trade secret and may change or be adapted at any time.

As you may already know, your daily activities, your dietary preferences and other habits will the data that will determine the result of the calculation. Bearing this in mind, there are a few clarifications to acknowledge and accept;

1. That the result you get, although quite accurate, is an approximation.
2. That to calculate your actual specific carbon foot print may not be possible; therefore, we do not guarantee such.
3. The carbon foot print calculator, although able to calculate your estimated future carbon emission, cannot predict the future, therefore, will only give an estimated result based on the information you provide.

6.1 To use the Kaci mobile application (“App”), you will need an active Apple ID, Google account, or another account supported by your device’s official app marketplace. You may download the App from the Apple App Store, Google Play Store, or another authorized store onto your mobile device or tablet.
6.2 Upon installation, you are required to register an account (“Account”) before you can use the App. The Account may be linked to your mobile device or tablet through the telephone number you provide during registration.
6.3 You agree that all information provided during registration is accurate, current, and complete. You further agree to update such information as necessary to maintain its accuracy.
6.4 You may only create one Account per device and per user. The Company reserves the right to suspend or terminate duplicate accounts.
6.5 You are responsible for maintaining the confidentiality of your Account details, including your login credentials and any verification codes.
6.6 You are solely responsible for all activities that occur under your Account, whether or not you have authorized such activities.
6.7 The Company reserves the right to suspend or terminate your Account at any time if it reasonably believes that you have violated these Terms or engaged in unauthorized, fraudulent, or unlawful activities.
6.8 How to Register
For clarity, the registration process works as follows:
Step 1: Search for Kaci Help on the Apple App Store or Google Play Store, or visit www.kaci.help/download.
Step 2: Sign up using your active phone number. Verification will be completed via WhatsApp, SMS, or Email.
Step 3: Complete your Profile by entering accurate details, uploading your image, and selecting your current location (this is critical for emergency response).
Step 4: Add at least two trusted Guardians by providing their full name, phone number, and email. Kaci will alert your Guardians when you request help.
Step 5: Once registration is complete, your unique Kaci Security Number (KSN) will be automatically generated.
6.9 Upon completion of registration, you will gain immediate access to Kaci’s free features. To explore additional premium features and benefits, you may visit www.kaci.help/sub and upgrade your account at any time.

Kaci offers flexible subscription options to ensure timely access to assistance and related services. Subscriptions are based on the number of requests a user can make per week (covering Emergencies, Consultations, TravelSafe, and more) over a 4-week (28-day) period, with additional options available under Custom Plans or Kaci Codes. 7.1 Kaci Code
Kaci Codes are unique codes generated either automatically (e.g., through app interactions or rewards) or manually (e.g., purchased directly or issued through partnerships with corporate or nonprofit organizations). These codes serve as access keys that extend or unlock specific benefits, such as an increased number of requests within a given time frame (daily, weekly, monthly, or campaign-based).
Terms for Using a Kaci Code:
-You are authorized to redeem the Kaci Code within the terms and timeframe specified.
-You agree to comply with both Kaci’s Terms of Use and any additional terms attached to the code by its issuing organization.
-If a Kaci Code was issued by a third party (e.g., your employer, HMO, or partner organization), that organization’s usage rules may also apply.
-For assistance with your Kaci Code, please contact either the issuing organization or the Kaci Support Team.

7.2 Kaci Free Usage
All users are granted a limited number of free requests per week, allowing basic access to Kaci services such as TravelSafe, iReport, and Suggestion requests. These free allowances help first-time and casual users access essential services without payment or codes.
-The number of free requests resets weekly and is subject to a fair use policy.
-If users exhaust their free requests, they may upgrade to a paid plan or redeem a Kaci Code to continue using services.

7.3 Kaci Plans
Kaci Help offers various subscription tiers to give users greater access to emergency and support services based on their needs:
-BASIC Plan: Ideal for light users. Includes a limited number of requests per week.
-LITE Plan: Best for users requiring moderate access. Includes consultations and is eligible for HMO integration on custom plans.
-PLUS Plan: Designed for high-demand users. Includes consultations with a higher number of requests and is eligible for advanced HMO integration on custom plans.
-AMBO Plan: Includes instant Ambulance Requests, consultations, and other listed services. It is valid only while the plan remains active.
-CUSTOM Plans: Special plans designed for specific events, seasons, or partnerships. These plans are not static and may vary based on request count or duration.
Important Notes:
-All plans, along with their requests and durations, cannot carry over unused requests. Once a plan expires, all limits reset, and your account reverts to the Free Plan unless renewed manually.
-Plan pricing is available on www.kaci.help/sub.
-Prices and request limits are subject to change at any time without prior notice.
-Subscriptions are non-refundable and non-transferable once paid.
-Your plan is tied to your registered phone number.

7.4 HMO Coverage
Kaci Help integrates NHIA-accredited Health Maintenance Organizations (HMOs) to provide verified medical coverage through the Lite and Plus Plans. Details of each plan are available on the subscription page.
HMO Activation Terms:
-Once you meet the requirements and your payment is confirmed, you will receive an HMO Badge that remains active until it expires. You can present this badge at any HMO office, hospital, or authorized location when required.
-Activation may take longer due to verification and data synchronization between Kaci Help, HMO partners, and hospital networks. This ensures fair, secure, and reliable healthcare access for all users.

7.5 Telemedicine Access
Users on Lite, Plus, Ambo, or Custom Plans can access verified telemedicine categories under the Consultation feature during their active subscription. Check the app for the full list of available categories.

FAQs (Frequently Asked Questions)
-Is the subscription monthly or yearly?
Most Kaci Help subscriptions run monthly (28 days). You’ll need to renew manually each month. Custom Plans may have longer durations.
-How do I pay for a subscription?
Payments are made securely online via Paystack or Flutterwave. After successful payment, you’ll receive a confirmation email.
-What happens if I don’t renew after 28 days (or the stipulated time)?
Your account automatically reverts to the Free Plan, and you’ll lose access to premium features or unused requests.
-Can I carry unused requests into the next month?
No. All request limits reset every month. Unused requests do not roll over.
-What is included in the Ambo Plan?
The Ambo Plan provides ambulance request service with other requests. It is valid only while the plan remains active.
-How do I change or upgrade my plan?
Log in to your subscription account and click the “Upgrade” button beside your current plan.
-Can I request a refund if I don’t use the app?
No. Once a subscription is paid for, it is non-refundable regardless of usage.
-Can I transfer my plan to someone else?
No. Plans are personal and tied to your registered phone number.
-Is there a limit to how many requests I can make?
Yes. Each plan comes with a set number of requests per week, except the Ambulance Plan, which is limited to once per month or per subscription.
-How does payment work?
All payments are made online via trusted gateways (Paystack or Flutterwave). A confirmation email is sent immediately after payment. Payments are not refundable, and plans are not transferable.
-Can I use my HMO plan for family or friends?
No. HMO and Telemedicine services are personal and tied to your verified Kaci Help ID. Sharing or unauthorized use is not allowed.
-What if I skip a month or my subscription becomes irregular?
Your HMO activation may pause or restart depending on your lock-in progress. You’ll need to maintain consecutive monthly payments to keep eligibility.
-Can I upgrade my HMO coverage?
Yes. You can switch from Lite to Plus or move to an annual plan by visiting www.kaci.help/sub
-What is the HMO Badge?
Once you meet activation requirements and payment is confirmed, you’ll receive an HMO Badge that remains active until expiry. You can present it at any HMO office, hospital, or authorized location.
-How long does HMO activation take?
Activation time may vary due to verification and data synchronization between Kaci Help, HMO partners, and hospital networks. This ensures fair and reliable healthcare access.
-Is my information secure?
Yes. Kaci Help uses end-to-end encryption and does not share your data with third parties.

8.1 Kaci and all materials and content contained therein are our property or the property of the persons who have granted us the applicable license (this also applies to the third-party software listed in the Kaci App). We grant you the right to use these materials and content, but only for the purposes of using Kaci in accordance to these Terms of Use.

8.2 We grant you the right to personally access and use Kaci. You are prohibited from transferring this right to anyone else, or to sell, give away or transfer your User Account to anyone else. Your right to access Kaci does not preclude us granting other persons the right to access Kaci.

8.3 Your right to use the name “Kaci” or any trademarks, logos, domain names or other characteristic trademarks whatsoever is limited to the scope defined in these Terms of Use.

8.4 In return for your warranty to comply with these Terms of Use, we grant you a limited, non-transferable, non-sublicensable, personalized, non-exclusive, revocable right to interact with Kaci to your device or to access the Website or the Screening Tool under the conditions set forth in these Terms of Use or the privacy policy, or under any terms applying to the App (WhatsApp or web browser) you may be interacting with Kaci from.

8.5 As the User, unless such behaviours are appropriately permitted in accordance with these Terms of Use or unless permitted under mandatory copyright law where necessary for the use of Kaci in accordance with its intended purpose and/or indispensable to obtain the information necessary to achieve the interoperability with other programs, you undertake to refrain from the following:

1. You, the User, agree not to replicate or copy Kaci, either in whole or in part.
2. You, the User, agree not to sell or otherwise make available Kaci, either in whole or in part, to anyone else.
3. You, the User, agree not to modify Kaci, in whole or in part, in any way whatsoever.
4. You, the User, warrant that you will not attempt to discover or access the source code of Kaci, in whole or in part, unless it has been expressly published by us and released into the public domain.

8.6 You are aware that we, and/or the persons who have granted us a license in this respect, are entitled to any confidential information, rights of use, of exploitation and of recovery, and any other intellectual property rights fully or partially existing, regarding Kaci.

8.7 Feedback/surveys. If you provide feedback, ideas or suggestions, or if you reply to surveys in connection with our Services (hereinafter referred as the “Feedback”), you acknowledge that the Feedback is not confidential and that you grant us a worldwide, non-exclusive, irrevocable, perpetual, royalty free and unlimited license to use your Feedback in any way, for any purpose, and through any medium or technology now known or unknown, whether in whole or in part, and whether as modified or unmodified. We will always use your Feedback in compliance with those Terms of Use, our Privacy Policy and any other applicable laws.

9.1 In addition to the other provisions in these Terms of Use, this section defines certain regulations relating to the use of Kaci (hereinafter referred to as “Regulations”).

9.2 The following is a list of activities that are prohibited in the context of using Kaci. You are prohibited to:

1. Circumvent, disable, or otherwise manipulate any of Kaci’s security features or any features preventing or restricting the use or copying of the content that is available via Kaci,
2. Create multiple User Accounts on Kaci (however, as far as Kaci functionality allows it, you may link your social networks or other accounts supported by us with the User account on Kaci),
3. Provide false or misleading information in the User Account details or registration,
4. Allow anyone else to use Kaci on your behalf or in your place, especially pertaining to medical & other personalized services
5. Use Kaci if we have temporarily suspended your right of use, or forbidden you to continue using it,
6. Send junk mail, spam or repeated messages,
7. Act in any unlawful or illegal manner,
8. Modify, interfere with, hack or disrupt Kaci, or to intercept messages,
9. Misuse Kaci or to infiltrate it with viruses, trojans, worms, logic bombs or anything else that might harm Kaci or any other user of Kaci equipment,
10. Extract data from Kaci except as permitted under these Terms of Use,
11. Post or contribute any abusive, threatening, obscene, misleading, untruthful, or offensive content, or content that contains any form of nudity or violence, and
12. Enter information or comments about any third-party without the consent of the third-party concerned.

9.3 The non-compliance with the Regulations listed in paragraph 9.2 represents a material breach of these Terms of Use, and may result in us, at our sole discretion, initiating the following measures – either individually or in combination:

1. The immediate, temporary suspension or permanent withdrawal of the right to access Kaci,
2. A warning being sent to you,
3. Initiation of legal proceedings against you, including a claim for reimbursement of any costs and expenses incurred due to the breach of agreement (including reasonable administrative costs and legal fees), and moreover
4. Disclosure of information to the law enforcement authorities, if and to the extent permitted by law and deemed by us to be necessary.

9.4 The reaction to a breach of agreement committed by you is not limited to the actions described in the preceding paragraph 9.3, i.e. we are entitled to take any further action in accordance with these Terms of Use and/or statutory law.

11.2 You should not take any action, make any decision, or rely on the information provided by Kaci without first consulting the appropriate professional or authority.

11.3 Due to the nature of technology and the internet, we do not guarantee that Kaci will always function without interruption, delay, fault, or error, or that it will always meet your expectations. We assume no obligation regarding the performance, quality, or availability of Kaci, and expressly disclaim any liability for technical or service-related issues.

11.4 By using Kaci, you agree that Kaci Help, its founder, operators, partners, affiliates, and licensors shall not be held liable under any circumstances for any damages, losses, injuries, claims, or expenses of any kind arising from or in connection with the use of Kaci, whether direct, indirect, incidental, consequential, or otherwise, even if we have been advised of the possibility of such damages. Please note that by using Kaci, you agree that you are responsible for how you use it, and you do so at your own discretion and choice.

17.1 Our current headquarters is located in Nigeria. The agreement concluded on the basis of these Terms of Use is subject to the laws of the Federal Republic of Nigeria. Without prejudice to the above choice of jurisdiction, in the case of agreements between traders and consumers, the provisions of the law of the country in which the consumer is habitually resident and which – under the law of that country – may not be derogated from, may be applied in favour of the consumer if the trader:

1. pursues his/her commercial or professional activities in the country of the consumer’s habitual residence, or
2. such activities are in any way directed at that country or at several countries including that country, and the agreement falls within the scope of such activities.

17.2 The courts of Nigeria have the exclusive jurisdiction to settle any disputes arising in connection with, or as a result of, your use of Kaci.

17.3 Kaci does not participate in dispute settlement proceedings before a consumer arbitration board.

You agree to defend (at our request), indemnify, and hold harmless Kaci, its parent company, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorney’s fees) arising out of or related to:
a) your actual or alleged breach of these Terms, including any representations, warranties, or obligations;
b) your use, misuse, or inability to use the Services;
c) your violation of any law, regulation, or third-party rights, including intellectual property rights, rights of publicity, confidentiality, or privacy; and
d) any content, information, or data you provide, share, or transmit through the Services.
This indemnification obligation will survive the termination, suspension, or expiration of your account or use of the Services, and will continue to apply regardless of whether you discontinue using the Services.

26.1 Kaci sends only notifications to dependants, partners, or agencies and does not provide security, emergency, or help services. Users are solely responsible for contacting and reaching out to the nearest emergency services or relevant authorities if they need help. Kaci cannot be held responsible for any issue, mistake, delay, miscommunication, or any other reason resulting from the use of the Mobile Application, WhatsApp, SMS notifications, or any integrated service.
26.2 Service-Specific Disclaimers
26.2.1 SOS Alerts: Kaci provides an SOS notification service. It is not a substitute for contacting emergency services such as the Police, Fire Service, Medical Ambulance, or other government agencies. Kaci disclaims all responsibility for non-delivery, delays, or inaccuracies in SOS alerts.
26.2.2 TravelSafe: The TravelSafe feature provides travel details and notifications to selected dependants. It does not guarantee physical safety, transport reliability, or protection against harm.
26.2.3 Beeps on Kaci Help: Beeps are not alerts. They are posts shared on Kaci Help in the form of text, images, videos, or voice recordings. While these posts may reach Guardians, partners, or other users, Kaci makes no guarantee of delivery, timeliness, accuracy, confidentiality, or effect.
26.2.4 Location Services: Kaci may provide approximate location services. These are dependent on third-party GPS, mobile networks, and data providers. Accuracy is not guaranteed, and service interruptions may occur.
26.2.5 Data & Communication: Notifications via WhatsApp, SMS, push notification, or other channels are dependent on third-party providers. Kaci will not be responsible for errors, delays, failures, or nondelivery caused by those platforms.
26.3 No Warranties: We provide the Services “as is” and make no representations or warranties, whether express or implied, regarding their use or that the Services will be error-free. To the maximum extent permitted under applicable law, Kaci disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no guarantees regarding the suitability, performance, completeness, accuracy, reliability, availability, or operation of the Services or any information contained within.
26.4 Limitation of Liability: You expressly agree that your use of, or inability to use, the Services or any Content, data, or other information found in the Services, is at your sole risk. Kaci, its officers, directors, employees, affiliates, licensors, suppliers, and partners shall not be liable for any indirect, incidental, consequential, exemplary, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or failure of emergency notifications.
26.5 User Responsibility: Users acknowledge that Kaci is only a notification tool and does not act as a government agency, security company, hospital, ambulance service, or emergency responder. By using the Services, users agree to take full responsibility for their personal safety and to independently contact emergency services whenever necessary.
26.6 Waiver of Claims: By using the Services, you waive any claim against Kaci for failure, error, or delay in sending notifications or any consequences thereof. Your sole and exclusive remedy for dissatisfaction with the Services will be to discontinue use of the Services.
26.7 Governing Law: This Disclaimer and any disputes relating to it shall be governed and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to conflict of law provisions.
